Despre necesitatea reevalu\u00c4\u0192rii conceptelor de \u00e2\u20ac\u017elucr\u00c4\u0192tor\u00e2\u20ac\u009d \u00c8\u2122i \u00e2\u20ac\u017esubordonare\u00e2\u20ac\u009d<\/em><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Rezumat<\/p>\n<p>Evolu\u00c8\u203aia tehnologic\u00c4\u0192 a condus la reducerea costurilor tranzac\u00c8\u203aiilor, cre\u00c8\u2122terea eficien\u00c8\u203aei economice, contestarea industriilor clasice, schimbarea modelelor de afaceri \u00c8\u2122i dezvoltarea unor noi forme de munc\u00c4\u0192.<\/p>\n<p>Acest studiu \u00c3\u00ae\u00c8\u2122i propune o analiz\u00c4\u0192 a impactului pe care dezvoltarea tehnologiilor \u00c3\u00ael genereaz\u00c4\u0192 \u00c3\u00aen planul raporturilor de munc\u00c4\u0192, care se \u00c3\u00aendep\u00c4\u0192rteaz\u00c4\u0192 tot mai mult de la tiparul clasic, specific economiei industriale, \u00c3\u00aen care munca se presta, ca regul\u00c4\u0192, \u00c3\u00aen baza unui program de lucru uniform \u00c8\u2122i de la locuri de munc\u00c4\u0192 organizate de angajator.<\/p>\n<p>Astfel, pe m\u00c4\u0192sur\u00c4\u0192 ce rela\u00c8\u203aiile de munc\u00c4\u0192 se transform\u00c4\u0192 \u00c3\u00aen ce prive\u00c8\u2122te modul de organizare al muncii \u00c8\u2122i, implicit, prin raportare la con\u00c8\u203ainutul raportului de subordonare, grani\u00c8\u203aa \u00c3\u00aentre munca independent\u00c4\u0192 \u00c8\u2122i cea subordonat\u00c4\u0192 se estompeaz\u00c4\u0192.<\/p>\n<p>A\u00c8\u2122a fiind, acest articol pune \u00c3\u00aen dezbatere c\u00c3\u00a2teva probleme fundamentale, de al c\u00c4\u0192ror r\u00c4\u0192spuns, \u00c3\u00aen opinia noastr\u00c4\u0192, depinde g\u00c4\u0192sirea cheii pentru reconstruirea legisla\u00c8\u203aiei muncii, \u00c3\u00aen scopul adapt\u00c4\u0192rii sale la noile realit\u00c4\u0192\u00c8\u203ai de pe pia\u00c8\u203aa muncii.<\/p>\n<p>Aceste probleme vizeaz\u00c4\u0192 (i) a stabili dac\u00c4\u0192 dreptul muncii ar trebui s\u00c4\u0192 ocroteasc\u00c4\u0192 munca, indiferent de forma juridic\u00c4\u0192 \u00c3\u00aen care este prestat\u00c4\u0192; (ii) necesitatea reconfigur\u00c4\u0192rii criteriilor \u00c3\u00aen func\u00c8\u203aie de care se poate distinge \u00c3\u00aentre munca independent\u00c4\u0192 \u00c8\u2122i munca subordonat\u00c4\u0192 \u00c8\u2122i (iii) cristalizarea nivelului de protec\u00c8\u203aie ce ar trebui instituit prin normele dreptului muncii \u00c3\u00aen favoarea lucr\u00c4\u0192torilor, raportat la gradul de independen\u00c8\u203a\u00c4\u0192 \u00c3\u00aen organizarea muncii \u00c8\u2122i specificul acesteia.<\/p>\n<p>Cuvinte cheie: lucr\u00c4\u0192tor, subordonare, munc\u00c4\u0192 independent\u00c4\u0192, munc\u00c4\u0192 subordonat\u00c4\u0192[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Conf. univ. dr. Ne r\u00c4\u0192spund actorii pie\u00c5\u00a3ei muncii prin utilizarea a\u00c5\u0178a-numitelor \u00e2\u20ac\u0153norme conflictuale\u00e2\u20ac\u009d. Principiul lex voluntatis constituie una din versiunile acestor norme. Aceasta nu este singura versiune. Prezenta contribu\u00c5\u00a3ie exploreaz\u00c4\u0192 succint versiunile normelor conflictuale familiare pie\u00c5\u00a3ei muncii. Munca pe platformele digitale de munc\u00c4\u0192 ofer\u00c4\u0192 lucr\u00c4\u0192torilor posibilitatea de a lucra din orice loc, \u00c3\u00aen orice moment \u00c8\u2122i de a ocupa orice loc de munc\u00c4\u0192 li se potrive\u00c8\u2122te. Potrivit unei estim\u00c4\u0192ri citat\u00c4\u0192 de Forumul Economic Mondial, 65 % dintre copiii care intr\u00c4\u0192 \u00c3\u00aen prezent \u00c3\u00aen \u00c8\u2122coala primar\u00c4\u0192 vor avea un loc de munc\u00c4\u0192 ce nu exist\u00c4\u0192 \u00c3\u00aenc\u00c4\u0192. Noile tehnologii din cadrul celei de a patra revolu\u00c8\u203aii industriale conduc o mare parte din aceast\u00c4\u0192 schimbare, av\u00c3\u00a2nd consecin\u00c8\u203ae nu numai asupra tipului de loc de munc\u00c4\u0192 sau a con\u00c8\u203ainutului muncii dar \u00c8\u2122i asupra formei rela\u00c8\u203aiei de munc\u00c4\u0192, a mediului de lucru, asupra flexibilit\u00c4\u0192\u00c8\u203aii condi\u00c8\u203aiilor de lucru, etc. Noi drepturi, cum ar fi \u00e2\u20ac\u017edreptul la deconectare\u00e2\u20ac\u009d \u00c8\u2122i-au f\u00c4\u0192cut loc \u00c3\u00aen domeniul ocup\u00c4\u0192rii for\u00c8\u203aei de munc\u00c4\u0192 \u00c8\u2122i au \u00c3\u00aenceput s\u00c4\u0192 fie reglementate \u00c3\u00aen legisla\u00c8\u203aie.<\/p>\n<p>At\u00c3\u00a2t legisla\u00c8\u203aia na\u00c8\u203aional\u00c4\u0192, c\u00c3\u00a2t \u00c8\u2122i cea la nivelul UE trebuie s\u00c4\u0192 \u00c8\u203ain\u00c4\u0192 pasul cu ritmul rapid al schimb\u00c4\u0192rilor, iar UE este \u00c3\u00aen permanen\u00c8\u203a\u00c4\u0192 preocupat\u00c4\u0192 de impactul noilor tehnologii, \u00c3\u00aen special asupra viitoarelor condi\u00c8\u203aii sociale \u00c8\u2122i de ocupare a for\u00c8\u203aei de munc\u00c4\u0192 din statele sale membre.<\/p>\n<p>Dovad\u00c4\u0192 sunt evolu\u00c8\u203aiile la nivelul UE din ultimii ani dar si preocup\u00c4\u0192rile sale viitoare. La 17 noiembrie 2017, Parlamentul European, Consiliul \u00c8\u2122i Comisia au semnat \u00c3\u00aempreun\u00c4\u0192 Pilonul european al drepturilor sociale. Pilonul se bazeaz\u00c4\u0192 pe 20 de principii esen\u00c8\u203aiale pentru a aduce la \u00c3\u00aendeplinire drepturi noi \u00c8\u2122i mai eficiente pentru cet\u00c4\u0192\u00c8\u203aenii UE. Pilonul consacr\u00c4\u0192 principii precum echilibrul dintre via\u00c8\u203aa profesional\u00c4\u0192 \u00c8\u2122i cea privat\u00c4\u0192, informa\u00c8\u203aii cu privire la condi\u00c8\u203aiile de \u00c3\u00aencadrare \u00c3\u00aen munc\u00c4\u0192, prevenirea precarit\u00c4\u0192\u00c8\u203aii \u00c8\u2122i alte aspecte care abordeaz\u00c4\u0192 provoc\u00c4\u0192rile generate de evolu\u00c8\u203aiile tehnologice. El va declan\u00c8\u2122a ac\u00c8\u203aiuni suplimentare din partea institu\u00c8\u203aiilor UE \u00c8\u2122i a statelor membre, inclusiv \u00c3\u00aen ceea ce prive\u00c8\u2122te noile tehnologii.<\/p>\n<p>\u00c3\u017dntr-adev\u00c4\u0192r, recent adoptata directiv\u00c4\u0192 privind transparen\u00c8\u203aa \u00c8\u2122i previzibilitatea condi\u00c8\u203aiilor de munc\u00c4\u0192 urm\u00c4\u0192re\u00c8\u2122te s\u00c4\u0192 \u00c3\u00aembun\u00c4\u0192t\u00c4\u0192\u00c8\u203aeasc\u00c4\u0192 situa\u00c8\u203aia lucr\u00c4\u0192torilor afla\u00c8\u203ai \u00c3\u00aen forme de munc\u00c4\u0192 atipice sau condi\u00c8\u203aii de munc\u00c4\u0192 mai pu\u00c8\u203ain previzibile, pun\u00c3\u00a2nd \u00c3\u00aen aplicare mai multe din principiile Pilonului. \u00c3\u017dn acela\u00c8\u2122i timp, \u00c3\u00aen 2018, o recomandare a Consiliului a sus\u00c8\u203ainut ideea de a oferi acces la o protec\u00c8\u203aie social\u00c4\u0192 adecvat\u00c4\u0192 pentru to\u00c8\u203ai lucr\u00c4\u0192torii \u00c8\u2122i pentru lucr\u00c4\u0192torii care desf\u00c4\u0192\u00c8\u2122oar\u00c4\u0192 o activitate independent\u00c4\u0192, referindu-se, printre altele, la necesitatea de a aborda schimb\u00c4\u0192rile de pe pie\u00c8\u203aele europene ale for\u00c8\u203aei de munc\u00c4\u0192 determinate de evolu\u00c8\u203aiile tehnologice.<\/p>\n<p>Reamintim \u00c8\u2122i c\u00c4\u0192 UE se afl\u00c4\u0192 \u00c3\u00aentr-o perioad\u00c4\u0192 de schimbare, cu un nou Parlament European \u00c8\u2122i o nou\u00c4\u0192 Comisie care \u00c3\u00ae\u00c8\u2122i preia mandatul \u00c3\u00aen 2019. Angajatorul, conform Codului muncii are obliga\u00c8\u203aia s\u00c4\u0192 trimit\u00c4\u0192 salaria\u00c8\u203aii\u00c2\u00a0 la formare profesional\u00c4\u0192 odat\u00c4\u0192 la 2 sau 3 ani \u00c3\u00aen func\u00c8\u203aie de num\u00c4\u0192rul de salaria\u00c8\u203ai angaja\u00c8\u203ai \u00c3\u00aen companie. Tot el are obliga\u00c8\u203aia,conform aceluia\u00c8\u2122i Cod, dup\u00c4\u0192 cum stim, dac\u00c4\u0192 are mai mult de 21 de salaria\u00c8\u203ai s\u00c4\u0192 elaboreze anual \u00c8\u2122i s\u00c4\u0192 aplice planuri de formare profesional\u00c4\u0192.<\/p>\n<p>Inteligen\u00c8\u203aa Arificial\u00c4\u0192 (IA) este \u00c8\u2122i r\u00c4\u0192m\u00c3\u00a2ne un subiect fierbinte \u00c8\u2122i \u00c3\u00aen domeniul rela\u00c8\u203aiilor de munc\u00c4\u0192, nu numai \u00c3\u00aen IT, cercetare, dar \u00c8\u2122i pentru c\u00c4\u0192 impacteaz\u00c4\u0192 d\u00c3\u00a9j\u00c3\u00a0 foarte mult pia\u00c8\u203aa for\u00c8\u203aei de munc\u00c4\u0192. Ea ne determin\u00c4\u0192 s\u00c4\u0192 \u00c3\u00aenv\u00c4\u0192\u00c8\u203a\u00c4\u0192m modul \u00c3\u00aen care s\u00c4\u0192 ne adapt\u00c4\u0192m din toate punctele de vedere, deci al dob\u00c3\u00a2ndirii de noi compete\u00c8\u203ae, noilor situa\u00c8\u203aii ce vor ap\u00c4\u0192rea. S-a subliniat c\u00c4\u0192 \u00e2\u20ac\u017ea patra revolu\u00c8\u203aie industrial\u00c4\u0192 va elimina milioane de locuri de munc\u00c4\u0192\u00e2\u20ac\u009d f\u00c4\u0192c\u00c3\u00a2ndu-se referire la implementarea IA \u00c3\u00aen toate domeniile de activitate. Consecin\u00c8\u203ae privind respectarea principiului egalit\u00c4\u0192\u00c8\u203aii de tratament.<\/strong><\/p>\n<p><strong><em>\u00c2\u00a0<\/em><\/strong><\/p>\n<p><strong><em>Rezumat <\/em><\/strong><\/p>\n<p>Munca prestat\u00c4\u0192 prin utilizarea platformei digitale, una din noile modalit\u00c4\u0192\u00c8\u203ai de prestare a muncii care au ap\u00c4\u0192rut la nivel european \u00c3\u00aen contextul digitaliz\u00c4\u0192rii, a devenit subiect de aprinse dezbateri.<\/p>\n<p>\u00c3\u017dn mod tradi\u00c8\u203aional, rela\u00c8\u203aia de munc\u00c4\u0192 are la baz\u00c4\u0192 un contract standard de munc\u00c4\u0192, pe o durat\u00c4\u0192 nedeterminat\u00c4\u0192, cu o norm\u00c4\u0192 integral\u00c4\u0192 de munc\u00c4\u0192, \u00c3\u00aen care locul de munc\u00c4\u0192 este delimitat spa\u00c8\u203aial, care reprezint\u00c4\u0192 un punct de referin\u00c8\u203a\u00c4\u0192 pentru a distinge \u00c3\u00aentre formele tipice \u00c8\u2122i atipice de prestare a muncii. Persoanele care presteaz\u00c4\u0192 munca prin intermediul platformelor digitale nu se pot \u00c3\u00aencadra cu u\u00c8\u2122urin\u00c8\u203a\u00c4\u0192 \u00c3\u00aen categoriile de salaria\u00c8\u203ai sau lucr\u00c4\u0192tori independen\u00c8\u203ai. Cercet\u00c4\u0192ri juridice doctrinare au avut ca scop at\u00c3\u00a2t sistematizarea diferitelor forme de prestare a muncii prin utilizarea platformelor digitale \u00c8\u2122i calificarea acestora, precum \u00c8\u2122i analizarea modului \u00c3\u00aen care normele tradi\u00c8\u203aionale de dreptul muncii se pot aplica acestor noi forme de prestare a muncii.<\/p>\n<p>Prezentul studiul reprezint\u00c4\u0192 un punct de pornire pentru a dezbate asupra modului \u00c3\u00aen care principiul egalit\u00c4\u0192\u00c8\u203aii de tratament \u00c3\u00aentre femei \u00c8\u2122i b\u00c4\u0192rba\u00c8\u203ai se aplic\u00c4\u0192 \u00c3\u00aen cazul prest\u00c4\u0192rii muncii prin utilizarea platformelor digitale. Programul-munca decent\u00c4\u0192 despre care s-a f\u00c4\u0192cut vorbire prima oar\u00c4\u0192 la Conferin\u00c8\u203aa din 1999 a fost adoptat oficial \u00c3\u00aen anul 2008, ca parte a ILO\u00e2\u20ac\u2122s Declaration on Social Justice for a Fair Globalization . \u00c3\u017dn cadrul acestei declara\u00c8\u203aii, s-a afirmat faptul c\u00c4\u0192 munca decent\u00c4\u0192 este fundamentul unei societ\u00c4\u0192\u00c8\u203ai productive, echitabile \u00c8\u2122i incluzive.<\/p>\n<p>\u00c3\u017dn fapt, se poate afirma c\u00c4\u0192 munca decent\u00c4\u0192 trebuie \u00c3\u00aen\u00c8\u203aeleas\u00c4\u0192 ca r\u00c4\u0192spuns efectiv la modific\u00c4\u0192rile sociale determinate de fenomenul globaliz\u00c4\u0192rii. Elementele definitorii ale muncii decente (dreptul fundamental al libert\u00c4\u0192\u00c8\u203aii, demnitatea uman\u00c4\u0192, securitatea social\u00c4\u0192, justi\u00c8\u203aia social\u00c4\u0192 \u00c8\u2122i non-discriminarea, dialogul social) pot determina, \u00c3\u00aen m\u00c4\u0192sura \u00c3\u00aen care acestea \u00c3\u00ae\u00c8\u2122i produc efectul corect \u00c3\u00aen cadrul unei societ\u00c4\u0192\u00c8\u203ai, dezvoltarea economic\u00c4\u0192 \u00c8\u2122i social\u00c4\u0192 durabil\u00c4\u0192 a acelei societ\u00c4\u0192\u00c8\u203ai.<\/p>\n<p>Raportat la acest concept ILO, prezentul studiu \u00c3\u00ae\u00c8\u2122i propune s\u00c4\u0192 analizeze:<\/p>\n<p>(i) Dac\u00c4\u0192 flexibilizarea raporturilor de munc\u00c4\u0192 ale unei categorii specifice de salaria\u00c8\u203ai \u00c3\u00aempieteaz\u00c4\u0192 sau nu conceptul de munc\u00c4\u0192 decent\u00c4\u0192;<\/p>\n<p>(ii) Dac\u00c4\u0192 raportul de subordonare \u00c3\u00aen cazul telemuncii este unul clasic sau unul atipic \u00c8\u2122i m\u00c4\u0192sura \u00c3\u00aen care acesta contribuie la atingerea dezideratului privind munca decent\u00c4\u0192.<\/p>\n<p>Cuvinte-cheie: munca decent\u00c4\u0192, telemunca, raportul de subordonare[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Asist. univ. dr. Actualitate \u00c8\u2122i perspective<\/em><\/strong><\/p>\n<p><strong><em>\u00c2\u00a0<\/em><\/strong><\/p>\n<p>Rezumat<\/p>\n<p>Lucrarea \u00c3\u00ae\u00c8\u2122i propune s\u00c4\u0192 analizeze inciden\u00c8\u203aa introducerii noilor tehnologii \u00c3\u00aen executarea unui raport juridic de munc\u00c4\u0192 cu timp de munc\u00c4\u0192 specific \u00c8\u2122i anume raportul de munc\u00c4\u0192 al conduc\u00c4\u0192torilor de autocamioane care realizeaz\u00c4\u0192 transport rutier.\u00c2\u00a0 Prima parte a lucr\u00c4\u0192rii cuprinde o descriere \u00c3\u00aen evolu\u00c8\u203aie a reglement\u00c4\u0192rilor referitoare la modalit\u00c4\u0192\u00c8\u203aile concrete de eviden\u00c8\u203aiere a tipului de activitate \u00c8\u2122i a timpului de munc\u00c4\u0192 \u00c3\u00aen cazul acestei categorii de salaria\u00c8\u203ai, insist\u00c3\u00a2nd asupra prevederilor Regulamentului\u00c2\u00a0 (CE) nr. 561\/2006 al PARLAMENTULUI EUROPEAN \u00c8\u2122i al CONSILIULUI privind armonizarea anumitor dispozi\u00c8\u203aii ale legisla\u00c8\u203aiei sociale \u00c3\u00aen domeniul transporturilor rutiere, de modificare a Regulamentelor (CEE) nr. 3821\/85 \u00c8\u2122i (CE) nr. 2135\/98 ale Consiliului \u00c8\u2122i de abrogare a Regulamentului (CEE) nr. 3820\/85 al Consiliului.<\/p>\n<p>Introducerea noilor tehnologii \u00c3\u00aen domeniul nostru de analiz\u00c4\u0192 (ex. tahografe) genereaz\u00c4\u0192 o serie de consecin\u00c8\u203ae \u00c3\u00aen privin\u00c8\u203aa statutului salariatului \u00c3\u00aen cauz\u00c4\u0192, consecin\u00c8\u203ae care pot fi analizate inclusiv din perspectiva respect\u00c4\u0192rii drepturilor sale prev\u00c4\u0192zute at\u00c3\u00a2t de legisla\u00c8\u203aia muncii c\u00c3\u00a2t \u00c8\u2122i de normele actului fundamental rom\u00c3\u00a2nesc (dreptul la securitate \u00c3\u00aen munc\u00c4\u0192, dreptul la respectarea vie\u00c8\u203aii private etc.).<\/p>\n<p>Dezbaterea public\u00c4\u0192 asupra pachetului legislativ \u00e2\u20ac\u017eMobilitate\u00e2\u20ac\u009d prezint\u00c4\u0192 deopotriv\u00c4\u0192 interes pentru subiectul analizat pornind de la efectele pe care reglement\u00c4\u0192rilor propuse le vor produce asupra acestei forme de\u00c2\u00a0 raport juridic de munc\u00c4\u0192 cu timp de munc\u00c4\u0192 specific.<\/p>\n<p>Cuvinte-cheie: timp de munc\u00c4\u0192 specific, noi tehnologii, tahografe, drepturi \u00c8\u2122i libert\u00c4\u0192\u00c8\u203ai, pachetul Mobilitate[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Conf. Digitizarea, digitalizarea \u00c8\u2122i dezvoltarea comunica\u00c8\u203aiilor wireless au f\u00c4\u0192cut posibil\u00c4\u0192 transformarea digital\u00c4\u0192 \u00c8\u2122i dezvoltarea unor programe de inteligen\u00c8\u203aa artificial\u00c4\u0192 opera\u00c8\u203aionale.<\/p>\n<p>Gestiunea efectelor celei de a patra revolu\u00c8\u203aii industriale din punct de vedere politic, juridic \u00c8\u2122i economic constituie o provocare. Efectele asupra pie\u00c8\u203aei for\u00c8\u203aei de munc\u00c4\u0192 \u00c8\u2122i a organiz\u00c4\u0192rii muncii sunt insuficient conturate \u00c8\u2122i \u00c3\u00aen\u00c8\u203aelese. Dar, oricum, aceast\u00c4\u0192 activitate se grefa \u00c3\u00aenc\u00c4\u0192 din 2003 pe munca la domiciliu sau, mai cur\u00c3\u00a2nd, \u00c8\u203aine de specificul ei potrivit legisla\u00c8\u203aiei speciale din \u00c3\u00aenv\u00c4\u0192\u00c8\u203a\u00c4\u0192m\u00c3\u00a2ntul (mai ales) universitar (dintotdeauna), a\u00c8\u2122a cum am precizat.<\/p>\n<p>\u00c3\u017dn consecin\u00c8\u203a\u00c4\u0192, ar urma ca at\u00c3\u00a2t contractele individuale de munc\u00c4\u0192 ale cadrelor didactice, c\u00c3\u00a2t \u00c8\u2122i regulamentul intern ori celalelte regulamente etc. s\u00c4\u0192 fie adaptate cerin\u00c8\u203aelor Legii nr. 81\/2018. Tehnologia permite at\u00c3\u00a2t societ\u00c4\u0192\u00c5\u00a3ilor private, c\u00c3\u00a2t \u00c5\u0178i autorit\u00c4\u0192\u00c5\u00a3ilor publice s\u00c4\u0192 utilizeze date cu caracter personal la un nivel f\u00c4\u0192r\u00c4\u0192 precedent \u00c3\u00aen cadrul activit\u00c4\u0192\u00c5\u00a3ilor lor, astfel \u00c3\u00aenc\u00c3\u00a2t protec\u00c5\u00a3ia efectiv\u00c4\u0192 a datelor cu caracter personal \u00c3\u00aen \u00c3\u00aentreaga Uniune necesit\u00c4\u0192 nu numai consolidarea \u00c5\u0178i stabilirea \u00c3\u00aen detaliu a drepturilor persoanelor vizate \u00c5\u0178i a obliga\u00c5\u00a3iilor celor care prelucreaz\u00c4\u0192 \u00c5\u0178i decid prelucrarea datelor cu caracter personal, ci \u00c5\u0178i competen\u00c5\u00a3e echivalente pentru monitorizarea \u00c5\u0178i asigurarea conformit\u00c4\u0192\u00c5\u00a3ii cu normele de protec\u00c5\u00a3ie a datelor cu caracter personal \u00c5\u0178i sanc\u00c5\u00a3iuni echivalente pentru infrac\u00c5\u00a3iuni \u00c3\u00aen statele membre.<\/p>\n<p>Prezentul studiu \u00c3\u00ae\u00c8\u2122i propune s\u00c4\u0192 identifice \u00c8\u2122i s\u00c4\u0192 clarifice unele aspecte privind modul \u00c3\u00aen care se poate asigura protec\u00c8\u203aia datelor cu caracter personal la locul de munc\u00c4\u0192 \u00c3\u00aen era digital\u00c4\u0192 at\u00c3\u00a2t sub aspectul con\u00c8\u203ainutului acestora c\u00c3\u00a2t \u00c8\u2122i cel al prelucr\u00c4\u0192rii lor.\u00c2\u00a0 Datele cu caracter personal \u00c3\u00aenglobeaz\u00c4\u0192 elemente specifice, proprii identit\u00c4\u0192\u00c5\u00a3ii fizice, fiziologice, genetice, psihice, economice, culturale sau sociale ale angajatului, ceea ce determin\u00c4\u0192 examinarea acestora la locul de munc\u00c4\u0192 \u00c3\u00aen conjunc\u00c8\u203aie cu confiden\u00c8\u203aialitatea datelor sau informa\u00c8\u203aiilor de care angajatul a luat cuno\u00c8\u2122tin\u00c8\u203a\u00c4\u0192 \u00c3\u00aen timpul execut\u00c4\u0192rii contractului de munc\u00c4\u0192 indiferent de tipul acestuia (forma tipic\u00c4\u0192 sau atipic\u00c4\u0192) \u00c8\u2122i datelor referitoare la starea de s\u00c4\u0192n\u00c4\u0192tate. Despre necesitatea reevalu\u00c4\u0192rii conceptelor de \u00e2\u20ac\u017elucr\u00c4\u0192tor\u00e2\u20ac\u009d \u00c8\u2122i \u00e2\u20ac\u017esubordonare\u00e2\u20ac\u009d<\/em><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Rezumat<\/p>\n<p>Evolu\u00c8\u203aia tehnologic\u00c4\u0192 a condus la reducerea costurilor tranzac\u00c8\u203aiilor, cre\u00c8\u2122terea eficien\u00c8\u203aei economice, contestarea industriilor clasice, schimbarea modelelor de afaceri \u00c8\u2122i dezvoltarea unor noi forme de munc\u00c4\u0192.<\/p>\n<p>Acest studiu \u00c3\u00ae\u00c8\u2122i propune o analiz\u00c4\u0192 a impactului pe care dezvoltarea tehnologiilor \u00c3\u00ael genereaz\u00c4\u0192 \u00c3\u00aen planul raporturilor de munc\u00c4\u0192, care se \u00c3\u00aendep\u00c4\u0192rteaz\u00c4\u0192 tot mai mult de la tiparul clasic, specific economiei industriale, \u00c3\u00aen care munca se presta, ca regul\u00c4\u0192, \u00c3\u00aen baza unui program de lucru uniform \u00c8\u2122i de la locuri de munc\u00c4\u0192 organizate de angajator.<\/p>\n<p>Astfel, pe m\u00c4\u0192sur\u00c4\u0192 ce rela\u00c8\u203aiile de munc\u00c4\u0192 se transform\u00c4\u0192 \u00c3\u00aen ce prive\u00c8\u2122te modul de organizare al muncii \u00c8\u2122i, implicit, prin raportare la con\u00c8\u203ainutul raportului de subordonare, grani\u00c8\u203aa \u00c3\u00aentre munca independent\u00c4\u0192 \u00c8\u2122i cea subordonat\u00c4\u0192 se estompeaz\u00c4\u0192.<\/p>\n<p>A\u00c8\u2122a fiind, acest articol pune \u00c3\u00aen dezbatere c\u00c3\u00a2teva probleme fundamentale, de al c\u00c4\u0192ror r\u00c4\u0192spuns, \u00c3\u00aen opinia noastr\u00c4\u0192, depinde g\u00c4\u0192sirea cheii pentru reconstruirea legisla\u00c8\u203aiei muncii, \u00c3\u00aen scopul adapt\u00c4\u0192rii sale la noile realit\u00c4\u0192\u00c8\u203ai de pe pia\u00c8\u203aa muncii.<\/p>\n<p>Aceste probleme vizeaz\u00c4\u0192 (i) a stabili dac\u00c4\u0192 dreptul muncii ar trebui s\u00c4\u0192 ocroteasc\u00c4\u0192 munca, indiferent de forma juridic\u00c4\u0192 \u00c3\u00aen care este prestat\u00c4\u0192; (ii) necesitatea reconfigur\u00c4\u0192rii criteriilor \u00c3\u00aen func\u00c8\u203aie de care se poate distinge \u00c3\u00aentre munca independent\u00c4\u0192 \u00c8\u2122i munca subordonat\u00c4\u0192 \u00c8\u2122i (iii) cristalizarea nivelului de protec\u00c8\u203aie ce ar trebui instituit prin normele dreptului muncii \u00c3\u00aen favoarea lucr\u00c4\u0192torilor, raportat la gradul de independen\u00c8\u203a\u00c4\u0192 \u00c3\u00aen organizarea muncii \u00c8\u2122i specificul acesteia.<\/p>\n<p>Cuvinte-cheie: lucr\u00c4\u0192tor, subordonare, munc\u00c4\u0192 independent\u00c4\u0192, munc\u00c4\u0192 subordonat\u00c4\u0192[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Prof. univ. dr.
